He and John T. HAWKINS* purchased 530 acres on the east bank of the Kentucky River from James, Walter C. and Greenberry SIMPSON
    • The SIMPSONs operated a ferry there, just downstream of the mouth of Lower Twin Creek, and the purchase included 7 houses and the ferry equipment and its operation. Farmers in the area used this location to ship their produce downstream (north) about 13 miles on the Kentucky river to the Ohio river. The purchase, for $15 per acre ($7,950), included 2 parcels that the SIMPSONs had purchased, 250 acres along the river and 280 adjacent acres on higher ground away from the river.

The plan of Dr. COCHRAN and John HAWKINS was to plat and establish a town on the flat portion of the land along the river, to be called Marion. Based on subsequent deeds selling off the lots, this ambitious plan included at least 245 lots. On 21 April 1820, eight months after the purchase, they filed a "bill of complaint" in Gallatin Circiut Court** against the SIMPSONs claming they did not have a valid deed for the 280 acre upland tract which they bought from John ADAMS of Richmond, Virginia, Executor of Richard ADAMS' estate, his father. COCHRAN and HAWKINS had learned that other ADAMS' family heirs were claiming that John ADAMS did not have authority to sell the land per the Will. In the complaint, they requested a cancellation of the contract and return of the money already paid, plus reimbursement for buildings and improvements that they made. And if the SIMPSONs did not have the sufficient money, that COCHRAN and HAWKINS retain the 250 acres and be reimbursed for the 280 acres at the price they paid, $15 per acre ($4,200). The defendants countered that the 250 acres on the river where the town would be built and the associated ferry were the valuable part of the 530 acres, and that the more remote 280 acres was only worth $1 per acre, the amount they paid for it.

On 12 October 1821 the court issued a decree

      * HAWKINS, who married Mary RIGG in 1818, became a brother-in-law of Dr. COCHRAN's daughter, Lucy Ann Catharine, when she married Alexander Moxley RIGG, Sr. in 1832. The town of Marion was later renamed Moxley in honor of Alexander Moxley RIGG, Sr. Although the town is now extinct, the area is still known as Moxley.

** Owen County did not expand to include Marion until 28 February 1821, but the legal proceedings continued in the Gallantin County Court until concluded on 18 April 1829.

Hand written letter from Dr. William COCHRAN to his 4 living daughters, 6 months before his death

    • "My Dear Daughters, All -

"Not doubting but you wish to hear from me, I make the attempt to write to you, not in the strain of complaint but much lamentation. I have lost my poor old Jack, a loss I feel most sensibly, for he was to me almost everything. He knew my ways and my wants, and rendered me much service. You may judge my condition now with impaired eye sight, health but tolerable, and at my time of life without a special servant to wait on me, which I have always been accustomed to, is all bad enough. I will, however plod along the best I can. Your Brother Wm. [Dr. William Winston Cochran I] offers me Jackson, but I say no, for it would be in violation of all propriety to take from him what is an important auxiliary of his support. Old Jack was quite unwell on our trip down, and for three weeks before his death laboured under painful disease of his bowels and died on the 19th inst., perfectly in his senses and apparently quite happy. He desired that his funeral should be preached in Louisville by Henry Lytle in the centre Street church.

"So much of my time having been devoted to poor old Jack, I have seen nothing here to amuse or interest me. We have everything good to eat and drink, we are seated at our side table Batchellor like three times a day. We have separate beds and sleep in the same room. Indeed since here I have enjoyed nothing but the climate and the exhilarating sea breese. I miss even the old Buggy and my lone room, but much more you and all my children's society, and but for being here with your Brother Wm. I should seek other quarters, but alas, poverty, that fiend monster, has fixed my destiny and animates all my powers. Such however cannot be the case long. I will therefore submit and try to be contented. Yesterday, the 24th, the anniversary of St. John the Baptist, was celebrated in this place by the Masons with oration, Dinner, and Ball, in which I participated and everything ended pleasantly. And altho you may charge me with vanity or egotism, I will not withstanding, remark for your amusement, that at the Ball I became acquainted with several gentlemen whose manners and habits were congenial with my own, and feeling myself pretty well, and rather in a gay mood, I seemed to strike the fancy of a great many, and have been told since, that I was considered the most elegant man in the room. The Ladies particularly seemed to fancy me, and several expressed their surprise that I should remain unmarried. I plead old age as my excuse, which from my appearance, they would not admit to be a good one. Alas my day is o'er, and I shall never be placed in that condition. About you all, my thoughts are daily engrossed, and could I know you were happy, it would be my greatest Delight. When, or whether I shall ever see you again is uncertain. And when or whether I shall write to you again, is also uncertain, for blindness and my lame hand may prevent me. To your Brothers [John] Overton and Patrick [Henry], give my most ardent love, and to Edwd. G. [Judge Edward Garland], say I entertain the highest regard for him. To Mary, for her kindness to you, as well as myself, say my heart glows with love and the best feelings towards her. Jeanette and Mrs. [Clarisa Morris] Winston also posses a full share of my love and regard. To all my Grandchildren I send my love, and hope for their welfare.

"Present to Mr. Tunstal my respects and very high regard, and say that I often think of him and to A. Fontain, and especially his wife, present my respects and regard. And now having nothing more to say on which could interest you, again, be assured of the everlasting love of your old Father.

      Wm. Cochran

"Write to me and Wm. Often, and tell me something of Catherine. Your Sister Helen I daily think of & feel much concerned about her health. You cannot imagine how much I feel the loss of poor old Jack. I had him decently buried and followed him to his grave to a public burying ground where he is deposited in a bed of clean white sand on the beach of the Gulf Stream.
      Adieu, W.C."

    • "Death of Dr. Wm. Cochran - On the 19th of August, 1853, at Biloxi, Miss., Dr. Wm. Cochran breathed his last. He was born in Hanover county, Virginia, but for many years has been a citizen of Kentucky. He first removed to Lexington; for twenty years past he has been a resident of Louisville. For fifty years he was a practising [sp.] physician, and seemed to delight in aiding and assisting the poor rather than extending his practice to the more wealthy members of society. He was respected by all who knew him, and will be missed especially in his field of practice. He had attained his 74th year. His faithful old Negro, a body servant, was with him and died about the same time."

    Land Speculation
    • At age 30, Dr. William Cochran moved his young family (wife and 4 children) from Virginia to Lexington, Kentucky in early 1811, and re-established his medical practice with an advertisement in the Lexington Reporter on August 10th:

"Doctor Wm. Cochran. Having become a resident of the town of Lexington, offers his medical and shirurgical [sic] services to its inhabitants, and the adjacent country. From an experience of ten years in medical practice, he flatters himself he will be enabled to give satisfaction in the exercise of his profession - his residence is in the house lately occupied by Mrs. Irwin, and contiguous to Doctor Fishback and Mrs. Russel."

Dr. Cochran had inherited the majority of his father's wealth, which was successfully gained as a tobacco merchant in Virginia trading with his relatives in Glasgow, Scotland. The inheritance was mostly land and property in Virginia that Dr. Cochran probably sold for a large sum. One could speculate that as with a lot of prople in that era, he became interested in the cheaper land west of the Allegheny mountains, and thus moved to Kentucky.

Over the next 30 years, he was involved in many land transactions in north central Kentucky, moving his residence frequently, speculating in land for profit, maybe more so that his medical practice.

Writing in 1841 about his life, he said:

"Inclined somewhat to roaming, & which I am now satisfied was pecuniarily injurious to me, I changed my situations often. However always Engaged in a splendid Practice, for several years in Paris, Kentucky, Three winters in New Orleans, Some time in Boone County, Kentucky, and now in Louisville, Kentucky.

"I . . . have Extended my benefices perhaps too profusely, from being once affluent in fortune, am now poor & dependent. Surrounding circumstances influence all human affairs, and I have found that a man's prosperity or adversity greatly depends on the formation of his associates. Mine have been of the highest order, but of that class who were prone to speculation and from whom I caught the infection, and in common with most of them became bankrupt."

Their framed portraits, painted in Louisville, KY, circa 1840, were donated to The Filson Historical Society, Louisville, KY, on 20 May 2015 by William Winston COCHRANE IV. [47, 48]

There are county deeds, not for this land, but for personal property, recorded in 1830 that state he was living there on land purchased by his son, John O. Cochran. But based on county deeds, his son did not buy the land until 1833, and he sold it in 1835. Possibly he was renting and paying taxes on the land from 1829 until it was purchased in 1833.

  • Notes
    • A portion of the first written history of the Cochran family by Dr. Cochran:

"Of myself, by Christian name William, I could detail a great variety & many important incidents of my life, but not designing a history of which, at this time, I will merely make a concise statement of such Events as may Enable my numerous descendants to Know that I am the head of their American Ancestry (by name Cochran).

"Never having intentionally injured any human being, but on the contrary under the impulse of the best feelings, have Extended my benefices perhaps too profusely, from being once affluent in fortune, am now poor & dependent. Surrounding circumstances influence all human affairs, and I have found that a man's prosperity or adversity greatly depends on the formation of his associates. Mine have been of the highest order, but of that class who were prone to speculation and from whom I caught the infection, and in common with most of them became bankrupt. I am now living in the City of Louisville, still practicing my profession, & Enjoy almost alone the society of my children.

"At this time I have neither Father, Mother, Brother, sister, uncle, nor Aunt living. Nor have I any relatives by the name of Cochran in the United States that I know of Excluding my children. My career in this world must shortly close, & if any thing I have stated in the forgoing can be a clue to the pleasure and profit of my children, I now wish they may Enjoy it and be happy, and amidst the checquered lot of man in this life, whether prosperous or adverse, Endeavor to be contented, promote all the good in their power, and be virtuous & honest."

      - Dr. William Cochran, 17 Nov 1841 [6, 8]

He was born in Hanover county, Virginia, but for many years has been a citizen of Kentucky. He first removed to Lexington; for twenty years past he has been a resident of Louisville. For fifty years he was a practising (sp.) physician, and seemed to delight in aiding and assisting the poor rather than extending his practice to the more wealthy members of society. He was respected by all who knew him, and will be missed especially in his field of practice. He had attained his 74th year. His faithful old Negro, a body servant, was with him and died about the same time."

Of the virtues, amiability, and irreproachable character of the deceased, a numerous family and extensive acquaintance are most fully apprized; and that her religions resignation, after a painful and lingering disease, has insured her a happy immortality, none who knew her can doubt."
